The new framework of Royal Decree 88/2026
The recent Royal Decree 88/2026 Disposición 3212 del BOE núm. 38 de 2026 has modernised the regulation of the electricity sector to adapt it to European requirements and to open the door definitively to the active participation of the industrial consumer.
This new legal framework is what gives legal certainty to the integration of demand flexibility and, above all, regulates the entry of new strategic players: independent aggregators. Thanks to this legislation, companies that adopt these technologies not only meet the system’s standards but also enjoy a stable ecosystem in which to monetise their response capacity.
From self-consumption to active management
Until recently, the objective of industrial PV was maximum direct use, consuming 100% of solar production to avoid buying from the grid. Today, the paradigm has changed. It is no longer only a matter of «not spending», but of managing «when and how it is spent».
Flexibility is the ability of an industrial site to modify its consumption or generation profile in response to market prices or system needs. When that capacity is linked to a PV and battery installation, the factory ceases to be a passive subject and becomes a Virtual Power Plant (VPP).
In this new scenario, participation in the balancing markets is key. This is where the independent aggregator comes in, allowing both SMEs and large industrial companies to trade their flexibility, previously reserved for large power plants. The aggregator pools the flexibility of several companies, auctions it on the markets and shares the income generated, turning the factory not only into a flexible consumer but into an active player in the energy system.
Profitability
Linking PV with aggregation opens three new routes to profit:
- Battery arbitrage: If the photovoltaic installation includes storage, there is no longer any obligation to consume the surplus while the sun shines. The aggregator can decide to sell that energy at the moment of peak grid demand, when the price is significantly higher than the saving that would be obtained by consuming it in-house during shoulder hours.
- Voluntary interruptibility: The electricity grid pays for being willing to reduce consumption at specific moments. Thanks to photovoltaics and battery support, production does not stop, the energy source is simply switched, earning a premium from the electricity system.
- Peak power optimisation: Connecting the plant to a flexibility platform allows artificial intelligence to «smooth» demand peaks, using PV to avoid the extra costs of contracted capacity.
An integrated strategy
